STRATEGIC ASSESSMENT. Government regulation in lieu of law number 2 years 2022 about creating job has being sued to Constitutional Court by civilian such as student, academia and advocate. The representative of sue applicant, Viktor Santoso Tandiasa said the applicant had been listed their sue for formil testing of government regulation in lieu of law number 2 years 2022 creating job since since January 5th, 2023.
A formil testing is testing on constitution regulation related to the process of regulation which had been made and others which did not include material testing at Constitusional Court (MK, red). Viktor explained that he and his colleagues want to test that government regulation in lieu of law to UUD 1945.
Besides that, with law number 12 years 2011 about formulation of regulation which was changed with Law Number 13 years 2022 about secong change of Law Number 12 years 2011 about formulation of laws and regulations, legal verdict Number 138/PUU-VII/2009 and legal verdict Number 91/PUU-XVIII/2020.
Previously, President Jokowi had signed government regulation in lieu of law number 2 years 2022 about creating job which was replaced creating job law which previously has been stated conditional inconstitutional by Constitutional Court on November 2021.
This regulation has made based on urgent considerations of global economics condition which must be responded as the impact of Russo-Ukraine war. But those government regulation in lieu of law has resistenced by many parties because the substance of these government regulation has same with Law of creating job which had been state conditional inconstitutional by Constitutional Court. The content of government regulation in lieu of law has been cornered containing problematic articles that are detrimental to labor and the environment.
