STRATEGICASSESMENT.The general chairman of the Crescent Star Party (PBB) Yusril Ihza Mahendra has officially joined the lawsuit or sued against the Election Law Number 7 of 2017 concerning a closed proportional system at the Constitutional Court (MK). Yusril and UN Secretary General Afriansyah Ferry Noor volunteered as related parties. They officially participated in the lawsuit case number 114/PUU-XX/2022.
“We have included them as related parties in accordance with Law 7/2017 regarding closed proportions. Prof. Yusril and I are the applicants,” Ferry said when contacted by CNNIndonesia.com. Ferry said the Crescent Star Party supports reintroducing the closed proportional system. They argue that the current open proportional system is unfair for parties that do not have large capital.
He said the UN’s participation would patch the weaknesses of the lawsuit. According to him, the lawsuit has the potential to be rejected by the Constitutional Court because the applicants do not represent political parties. Ferry said this decision was made after the Crescent Star Party established communication with Indonesia Democratic Party-Struggle (PDIP, red). Both political parties support a closed proportional system.
PDIP did not submit itself to the Constitutional Court because it was involved in deliberating the Election Law. Therefore, the Crescent Star Party is advancing to the Constitutional Court because they feel they have a strong legal standing.
“We, as the party participating in the election, are participating in providing support to PDIP from the coalition, this collaboration. This is an initial assessment for us going forward,” said Ferry.
